Indian patents 2022

 







WIPO released statistics for 2022.

Indian patent office received 77,068 applications, 38,551 from residents and 38,517 from non-residents, more than Germany, the UK, France, Russia Australia, and Canada but less than China, USA, Japan, and Korea. Patents in force are 1,28,663 with non-residents share at 81.60% and most of them are in force for more than 10 years,

The 2023 edition of the Global Innovation Index (GII) takes the pulse of global innovation trends against the background of an economic environment fraught with uncertainty. WIPO patent landscape report- graphite and its applications

This Patent Landscape Report on Graphite and its Applications was prepared following a related request from Sri Lanka. This publication was prepared under the stewardship of Marco Alemán (Assistant Director General, IP and Innovation Ecosystems Sector), under the direction of Alejandro Roca Campañá (Senior Director, Technology and Innovation Support Division) and Andrew Czajkowski (Director, Technology and Innovation Support Division), with the generous financial support by Funds-In-Trust Japan Industrial Property Global provided by the Japan Patent Office. The report was prepared by a project team initially led by Irene Kitsara (IP Information Officer, Technology and Innovation Support Division) and then by Lakshmi Supriya (Patent Analytics Officer, Technology and Innovation Support Division), members from the patent analytics team of IPOS International comprising Alfred Yip (Director, Patent Search, Examination and Analytics), Huang Jinquan (Head, Patent Analytics), Sun Ting (Senior Analyst) and Pan Shanshan (Analyst), Björn Jürgens (Consultant), Craig Dsouza (Young Expert Professional, Technology and Innovation Support Division).

Conclusion:

The wide range of graphite applications has stemmed from an intensive research and development effort worldwide. Patent filings for graphite-related technologies have originated from over 60 countries across every region. However, although this suggests graphite innovation is global, it is actually the case that graphite-related patent families originate predominantly from just a few countries. Specifically, the top five applicant origins are China, Japan, the Republic of Korea, the United States and the Russian Federation. Together, they account for the vast majority (95 percent) of global patenting output. China is dominant among the top five applicant origins, responsible for four in every five graphite patent families filed worldwide in the last decade. It is most active in the exploitation of flake graphite, being home to the world’s second-largest reserve of natural graphite and the primary supplier of flake graphite to the global market. Artificial graphite, on the other hand, is a wellexplored alternative to natural graphite, especially in countries without a rich natural reserve, such the Republic of Korea. Battery applications were the key driver of graphite technologies, accounting for 10–15 percent of global graphite production. Among all graphite uses and products, graphite for battery applications is the one that has attracted the most intensive patent filing, with over 8,000 patent applications filed from 2012 to 2021. Such a high level of patenting activity is expected to continue, as the global effort to fight climate change intensifies. In particular, the explosive market growth of EVs and large-scale energy storage will demand more graphite innovations; for example, novel graphite-based anode solutions with greater energy density and better performance. The two other application areas that recorded intense patent activity were ceramics and heat dissipation. Ceramic applications have remained an active patenting field, attributable to their indispensable role in refractory applications. In addition, novel graphite-filled ceramic materials and composites have been explored for a broad range of uses, including in automotive and power machinery applications. Graphite for heat dissipation is one of the few areas where the rest of the world has shown a comparable patenting output to China, with substantial contributions coming from Japan, the Republic of Korea, the United States and Taiwan Province of China. As the level of power dissipation has increased owing to a continual performance improvement in electronics, research has shifted toward novel graphite-based compositions and microstructures for better heat dissipation performance.

Patents 2020


WIPO report analyzes IP activity around the globe. Drawing on 2020 filing, registration and renewals statistics from national and regional IP offices. India received 56,771 patent applications, ot of which 23,141 were from India, 10,478 from USA, 4826 from Japan, 3775 from China, 2682 from Korea and 2525 from Japan.Resident grants for India grew by 5.5% whereas that of non-residents grew at 6.3%. Non-Resident share of patents granted by Indian Patent Office were pegged at 81.1%. The situation was different for Industrial Designs where out of 12,793, resident applicants were 8962 and non-residents 3,831.India does not grant utility patents and is not a member of International Union for Protection of New Variety of Plants. Publishing industry data covered under Creative Economy do not have Indian data.

World Intellectual Property Indicators 2018 : creative economy

Applicants around the world filed almost 3.17 million patent applications in 2017. From 1883 to 1963, the patent office of the U.S. was the leading office for world filings. Application numbers in Japan and the U.S. were stable until the early 1970s, when Japan began to see rapid growth – a pattern also observed for the U.S. from the 1980s onward. Among the top five offices, Japan surpassed the U.S. in 1968 and maintained the top position until 2005. Since the early 2000s, however, the number of applications filed in Japan has followed a downward trend. Both the EPO and the Republic of Korea have seen increases each year since the early 1980s, as has China since 1995. China surpassed the EPO and the Republic of Korea in 2005, Japan in 2010 and the U.S. in 2011 – and it now receives the largest number of applications worldwide. Applicants from China filed around 1.31 million equivalent patent applications in 2017, which is more than the combined total for applicants from Japan (460,660), the Republic of Korea (226,568) and the U.S. (524,835). Those four origins, plus Germany (176,235), accounted for the bulk of the global total. However, it should be noted that only 4.6% of all applications from China are filed abroad, while 95.4% are filed in China. In contrast, filings abroad constitute 43.5% of total applications from Japan and 44% from the U.S.
In 2017, an estimated 1.4 million patents were granted worldwide, up 3.9% on 2016 figures, and represent 17 consecutive years of growth (see figure 1.7). China (420,144) issued the largest number of patents in 2017, followed by the U.S. (318,829), Japan (199,577), the Republic of Korea (120,662) and the EPO (105,645). These five offices issued more than 1.16 million patents between them – 83% of the world total.  India granted 50.2% more patents in 2017 than in 2016, with grants increasing from 8,248 in 2016 to 12,387 in 2017. Non-resident grants accounted for 85% of the total increase.

Applicants from China were the most active applicants in the world in 2017, filing 4,041 plant variety applications. This represents a 48.6% growth in filing activity for Chinese applicants – the fastest growth among the top 10 origins. They were followed by applicants from the Netherlands, who filed 3,320 applications. The U.S. (2,084), France (1,068) and Germany (865) were ranked third, fourth and fifth largest origins, respectively.
Creative Economy:  Data on the 2017 revenues generated by the three sectors – trade, educational and STM – are available for 11 countries. Those 11 countries generated USD 248 billion revenue in 2017. China (USD 202.4 billion) reported the largest net revenue, followed by the United States of America (U.S.) (USD 25.9 billion), Germany (USD 5.8 billion) and the United Kingdom (U.K.) (USD 4.7 billion)

Patent Cooperation Treaty Yearly Review 2018


Highlights from the report.

  • An estimated 243,500 international patent applications were filed under WIPO’s Patent Cooperation Treaty (PCT) in 2017.  With 56,158 filings, the United States Patent and Trademark Office (USPTO) received the highest number of PCT applications; it was followed by the State Intellectual Property Office of the People’s Republic of China (SIPO; 50,674), the Japan Patent Office (JPO; 47,425), the European Patent Office (EPO; 36,714), the Korean Intellectual Property Office (KIPO; 15,830) and the International Bureau (IB) of WIPO (10,212).
  • The business sector accounted for 84.8% of all published PCT applications, followed by individuals (8%), the university sector (5.4%) and the government and public research organizations (PROs) sector (1.9%).
  • Huawei Technologies was the top PCT applicant in 2017, with 4,024 published PCT applications. With 2,965 published PCT applications, ZTE Corporation moved from first to second place. These two Shenzhen-based companies were followed by U.S.-based Intel Corporation (2,637), Mitsubishi Electric Corporation of Japan (2,521) and Qualcomm Incorporated of the U.S. (2,163).
  • Among educational institutions, the University of California (482 published PCT applications) has remained the largest user of the PCT System since 1993 . The Massachusetts Institute of Technology (278) ranked second, followed by Harvard University (179), the University of Texas System (161) and Johns Hopkins University (129). 
  • Computer technology (19,122) was the most frequently featured technology field in published PCT applications in 2017, followed by digital communication (18,400), electrical machinery, apparatus, energy (15,223) and medical technology (15,024).
  • India filed 1603 PCT applications in 2017, 1528 in 2016 and 1412 in 2015. One third of Indian PCT applications have USA as designated country. 
  • India is an attractive destination for PCT applications. Indian patent office received 25,896 national phase entries in 2016 and 27,882 in 2015. 96.4% of PCT applications received at India office had date of priority.
  •  A relatively high share of PCT filings from India related to pharmaceuticals, Singapore - semiconductors, China- Audio Visual Technology, Computer technology, Sweden- Digital communication, Japan- Electrical Machinery, Israel- Medical technology, Netherlands- Optics, France- Transport.
  •  In 2017, less than half of all PCT applications (47.6%) were published in English, followed by Japanese (19.4%) and Chinese (15.7%).

China received more patent application than USA and Japan combined- WIPO

Year 2015 report on IP metrics was released by WIPO. Highlights:

  •  Around 2.68 million patent applications were filed worldwide in 2014. Indian Patent Office received 42,824 patent applications, 12,040 from India, 9,824 from USA, 5338 from Japan, 3,174 from Germany and only 880 from China. PCT applications not originating from India number 26,340.China tops the list with nearly a million applications, 80% from residents and mostly utility patent applications. India's patent position is higher than Russia, UK, France, Australia and near that of Germany.
  •  USPTO tops in patent grants with 3 lakh, India grants 6,153, mostly (5433) from non-residents. There are over 2 lakh patent applications pending in India compared to a million in USPTO.
  • Of the top 10 origins in the period 2011-13, Switzerland filed mainly in pharmaceuticals; the Russian Federation in food chemistry; France and Germany in transport; China, Japan and the Republic of Korea in electrical machinery; the Netherlands in medical technology; and the UK and the US in computer technology. Majority of applications in India are in Pharma and Computer technology.
  • An estimated 948,900 applications for utility patents were filed worldwide in 2014, of which 868,511 were received by SIPO. Resident applications made up 98% of all applications filed worldwide in 2014, showing that utility model applications are rarely filed abroad. Compared to patents, the Czech Republic, China Hong Kong (SAR), the Philippines, Slovakia and Ukraine are intense users of utility models.

World Intellectual Property Report 2015

Published every two years, the report looks at trends and interesting topics in IP. 2015's theme is 'Breakthrough Innovations' and examines key technologies that have had transformative economic effects.The report's concept is to gain better understanding of how breakthrough innovations come about and the relationship with IP. The report develops six case studies -- three past and three current breakthrough technologies -- to trace their economic impact and the factors which facilitated their development. 
The three historical are airplanes, antibiotics and semiconductors; the three current are 3d printing, nanotechnology and robotics. Each of these case studies is detailed from a historical perspective, complemented with statistical analysis of related patents and patent mapping, and an analysis of the relationship between the innovation and IP.The six case studies included in this report point to a number of well-known elements of success:


  • Governments have been the main source of funding for scientific research that was often instrumental in inventive breakthroughs. In many cases, governments have also played a crucial role in initially moving promising technology from the laboratory to the production stage – often motivated by national defense and industrial policy interests.
  • Competitive market forces and efforts on the part of firms were equally crucial, especially in commercializing promising ideas and engaging in follow on innovation that facilitated scaled-up production, cost reductions and wide-scale adoption of new technologies.
  • Linkages between the various innovation actors mattered. They ranged from informal knowledge exchanges, professional networks and worker movements to formal university–industry licensing frameworks and R&D collaborations. They promoted the sharing of knowledge among researchers and connected the upstream and downstream activities that helped transform promising ideas into commercial technologies.

China emerges as an important origin of patents in 3D printing, nanotechnology and robotics. In particular, looking at first patent applications filed since 2005, Chinese applicants account for more than a quarter of first filings worldwide in the case of 3D printing and robotics – the highest share among all countries. In the case of nanotechnology patent filings since 2005, Chinese applicants make up close to 15 percent of fillings worldwide – the third largest origin of patents. 

Sadly India does not figure anywhere, neither in patent generation nor as destination for patent protection.

PCT Applications 2015 and India

Some interesting bits from the report.:

  • Applications filed in 2014-214,500. National phase entries in 2013-565,500/-
  • Two of the top three applicants were located in China. With 3,442 applications published, Huawei Technologies Co. Ltd. of China became the top PCT applicant. For the first time, over 10% of the top 50 PCT applicants were from China.
  • Computer technology became the field with the highest number of PCT applications published (17,653) in 2014. It was followed by digital communication (16,165) and electrical machinery (15,220). Relative Specialization Index for India is highest in Pharmaceuticals.
  • Philips, Netherlands top the list of 50 PCT applicants (1995-2014).
  • From India, 1394 PCT applications were filed in 2014,little lower than Israel and higher than Singapore. China filed over 25,000/-
  • PCT applications as a share of resident applications for India was 0.13 implying that only 13% of those that filed for patents in India in 2013 filed for PCT in 2014. Israel, Singapore have conversion more than one reflecting numerous PCT applications with no prior residence filing.
  • Share of independent innovators is significant for middle income countries with Russia and South Africa leading in this classification.
  • Share of PCT applications with foreign co-applicant is relatively higher for India compared to China.
  • National Phase entries in India were 27,592 in 2013, higher than Brazil, Russia, South Africa.  Approximately 30% (1,176) of all NPEs originating in India were destined for the USPTO with 452 heading towards Europe.

Global innovation has become a three-horse race. Three countries—the US, Japan and China—accounted for over 60% of patent applications in 2014, according to a report released by the World Intellectual Property Office (WIPO)

  • The U.S. was the primary country of origin for PCT filers in 2014, with 61,492 applications and 7.1% growth. Japan followed with 42,459 applications, representing a 3% decline on 2013. Applicants from China filed 25,539 applications – an 18.7% annual increase.
  • Huawei Technologies Co., Ltd. of China, with 3,442 published PCT applications, overtook Panasonic Corp. of Japan as the largest applicant in 2014. U.S.-based Qualcomm Inc. was the second largest applicant in 2014, with 2,409 published applications, while China’s ZTE Corp. took third place with 2,179 PCT applications.
  • After China, India (1,394) is the largest user of the PCT system among BRICS countries, followed by the Russian Federation (890), Brazil (581) and South Africa (297).
  • The University of California, with 413 published applications, is the top applicant among educational institutions followed by the Massachusetts Institute of Technology (234), the University of Texas System (154) and Harvard University (147). 
  • Computer technology with 17,653 published applications – or 8.4% of the total – accounted for the largest share of PCT applications, followed by digital communication (7.7%) and electronic machinery (7.3%). Amongst the top 10 fields, computer technology saw the fastest growth (+19.4%), followed by medical technology (+17.1%) and digital communication (+14.5%). 
  • The share of pharmaceutical patenting via the PCT has continuously declined since 2007. Pharmaceutical patents represent the seventh largest field. Merck Sharp & Dohme Corp. is the largest filer with 171 applications, followed by Novartis AG (141), F. Hoffmann-La Roche AG (135) and the University of California (111).Universities and public research organizations show a strong presence in this field, accounting for 26% of pharmaceutical PCT filings. This is in contrast to computer technology and digital communication where these entities accounted for 4.6% and 2.8%, respectively.

WIPO Re:Search database on Intellectual property

 WIPO Re:Search, is a new consortium where public and private sector organizations share valuable intellectual property and expertise with the global health research community to promote development of new drugs, vaccines, and diagnostics to treat neglected tropical diseases, malaria, and tuberculosis. Alnylam Pharmaceuticals, AstraZeneca, Eisai, GlaxoSmithKline, MSD1, Novartis, Pfizer, and Sanofi are collaborating with WIPO, BVGH, the U.S. National Institutes of Health (NIH), and multiple non-profit research organizations. These include the California Institute of Technology, the Center for World Health & Medicine, the Drugs for Neglected Diseases initiative, Fundação Oswaldo Cruz (Fiocruz), Massachusetts Institute of Technology, Medicines for Malaria Venture, PATH, the South African Medical Research Council, the Swiss Tropical and Public Health Institute, the University of California, Berkeley, and the University of Dundee (UK).

New on-line tool to facilitate green technology patent searches

WIPO has launched an on-line tool that is linked to its International Patent Classification (IPC)
system to facilitate searches for patent information relating to environmentally sound
technologies (ESTs), as listed by the United Nations Framework Convention on Climate Change
(UNFCCC). The tool, the “IPC Green Inventory”, contains some 200 topics that are directly
relevant to ESTs, and each topic is linked with the most relevant IPC symbols.In addition to being linked to the IPC system, the IPC Green Inventory is hyperlinked to WIPO’s PATENTSCOPE® search service to automatically search and display all “green” international applications filed under the PCT.The IPC Green Inventory will help in identifying existing and emerging green technologies, as well as potential partners for further R&D and commercial exploitation.
